Common Questions

Answers About Your Injury Claim

What types of damages are available in a personal injury case?

In most cases, you can seek compensation for medical expenses, lost income, pain and suffering, disability, and other losses caused by the accident. You may also be entitled to future damages, such as ongoing medical treatment or reduced earning capacity. In wrongful death cases, families can pursue compensation for funeral expenses and other related losses.

In most cases, Louisiana law gives you two years from the date of the accident to file a personal injury lawsuit. (This changed from one year to two years for accidents on or after July 1, 2024; injuries before that date are generally limited to one year.) Some claims — like maritime or medical malpractice — follow different deadlines. Missing the deadline can permanently bar your claim, so it’s important to speak with an attorney as soon as possible.

Every case is different. The value of your claim depends on factors such as the severity of your injuries, your medical expenses (past and future), lost income, and how the accident affects your daily life and ability to work. After reviewing your case, we can give you a clearer understanding of what fair compensation may look like.

First, seek medical attention right away — even if your injuries seem minor. Prompt treatment protects both your health and your claim. Report the accident to the proper authorities, document the scene if you can, and avoid discussing fault with insurance companies. Then, contact our office so we can help protect your rights from the start.
